| (sorry, but no offense to our fine women jeepers on here =)
So, I'm heading home just a few minutes ago, have the doors off, just cruising, two lanes enter the freeway. I see a truck going really slow ahead in the left lane, so I pull into the right lane, and start accelerating. Hit about 60, getting on the freeway, and this stupid chick in a TSX who was behind him (he was doing about 30) decides to jump out into my lane right as I am catching up w/ them.
Long story short, I slam my brakes, take an evasive maneuver, and walk my driver's tire up the rear quarter of her car at about 45mph. (Thank god for shorty bumpers =) I pull over, cross the lanes to talk to her, and let her know I have no damage, so if she doesn't want want a hit on her insurance, I'll be happy to let her walk on it.
This dumb b**** has the gall to start telling me about how "her baby hit her head on the window" and I hit her from behind and it's all my fault, and she doesn't want to argue about it. "I don't care if I was changing lanes - you hit me from behind!" First thing tomorrow, she's going to get a nice call from the insurance company about the driving laws in Texas =)

| sorry for the accident..but sounds about right (for most drivers, m/f) once they're in an accident...$$$ go up and nothing is their fault..thus the reason I'm employed | |

| Yeah, it's funny how people will know they're in the wrong, and still try "just because." My last big accident, the lady filled out the police report explaining how she was at fault, and how she had caused the accident, and then spent a year and a half claiming she wasn't afterwards.
Jeep's perfectly fine, we just got back in from driving around. Funny enough, if I hadn't turned off to the right at the last second, I would've driven straight up her car - the sidewall caught and kicked me up for a second.
It took care of a squeak I was having though =)

| Wow That sucks! Hate to be a pessimist here... But if you didn't get the police out (the police could've sited here with unsafe lane change or something), or any witnesses. It will probably go down as your fault And likely she'll get an attorney to sue for medical. It sucks, but that is what you have insurance for. Couple years ago my son rear ended someone- clearly my son's fault. The other driver- another boy about 16-17 years old, was not injured because the speed of the accident was only about 15-20mph. A month later my insurance informs me that they were suing for medical (whiplash). I have Allstate, and Allstate offered up their usual $3000 to settle out of court, and the people declined- they wanted more. So they took it to court. Took over a year to get it to court. In court they won, but their judgement was only $1000, which their attorney got 40% LOL They should've taken Allstate's first offer | |

| My experience from previous cases is that if the police didn't actually see the incident, then their report is no more useful than anything else. I had a signed police report with the woman admittance of fault, and her having a ticket in my previous wreck, and she still fought it.
Fortunately, Progressive is very aggressive, at least they always have been for me. I think I'm going to have to install a dash cam for future use, and nip these things in the bud before they get started =)

| How did her baby hit the window? Was the car seat strapped in with bungie cords? I find that a lot of it does depend on how aggressive the insurance is. Some just settle and some fight for who is to blame. The problem is when you are not at fault and your insurance wants to settle because the person at fault has an insurance that is fighting to get off. | |

| did she get any of your info down? license plate #, insurance, TDL, etc? also, i would check the suspension, axle brackets and mount welds just to be sure. i'd hate for you to have a cracked weld an not know it until you're do 60 down the hwy or wheeling. also, you could report it to your insurance and tell it liek it happend, she almost side swiped you but hit your brakes and your "oversized , offroad" tires carried you up onto her car. if not for your alertness and defensive driving skills this accident would have been much worse !!! :mischievious: | |

| Oh yeah, I've thoroughly inspected everything - I hit rocks harder than I hit her =)
My adjuster came out today, said she fessed up to being at fault, but didn't seem to understand that made her at fault. ("I changed lanes and he hit me. But it's his fault - he rear-ended me.") Took pictures of my bumper and said, looking at her damage, and the lack of any impact with my bumper or even fender - well, it's obviously her fault. They'll take care of it from here.
In four accidents where they covered me not-at-fault, they have never once even mentioned me being at-fault. They fight tooth-and-nail (or at least, always have before =).

| GDAMN F'N CLUELESS (nappy headed hoes) WHO SHOULDN'T BE F'N DRIVING MOTHER F'ER AHOLES IN THIS TOWN/WORLD!!!!!!!
...driving home today, exit I-10 onto the feeder...speed I don't know (prob 45-50 MPH), I get on the 3 lane feeder road (far left lane of course) and here comes this F'n Bitch in her lil silver 350Z in the middle lane...as she begins to pass me what does she do...drifts off into my lane!!! Just before my front tire is about to crutch her little fender, I blow the horn, slam on the brakes and end up having to hop the curb (half on grass/half on pavement)...steering wheel shaking like a SOB. Regain control and speed back up with my window down, cussing like a sailor...this Bitch looks like she could be the sister of that black female on this years Big Brother (ya I know, blame it on Brandi)...she doesn't even look my way. To make matters worse she ends up behind me on Montrose (meaning she never even need to be in the left hand lane on the feeder). As she turns off Alan Parkway, I slow down for her to pass me...again not a f'n opps sorry my bad or anything!
If there is a next time, I might think twice about the curb and just do a Church and run up on that bitches fender (in hopes I dont' flip...lol)
OK, calming down now...cold Guinness by my side...

| You know...I used to record the license plates of those who piss me off, find there home number and leave a f'n message on their phone thats waiting on them when they get home (but too many cell phones now, make that harder to do) EDIT: besides I've gotten calmer now | |

| IMO as soon as she started pulling that crap about my baby hit it's head I would have said, let's call the cops and get an ambulance to make sure that it's OK - document that it is all good etc... and the cops report will not hurt your case if you did nothing wrong..... The rule is that if no one is hurt and the damage is less than $1000 then no paperwork has to be filed otherwise this report has to be filled out and sent to DOT - FNU, back me up on this it has been a heck of a long time since I worked traffic...... Glad you are ok!!!! that is what matters most!! | |
